Terms of Use

Effective as of August 24, 2026.

1. Purpose and acceptance

These Terms of Use ("Terms") govern the use of the Physio Pacing mobile application ("the App"), published by Gautier Maurickx (sole proprietorship, SIRET 105 168 371 00018, registered office 01800 Saint Jean de Niost, France).

The App offers personalized running training plans, generated from your MAS (Maximal Aerobic Speed), your race goal, your availability and your personal constraints.

By downloading, installing or using the App, you accept these Terms in full. If you do not agree, uninstall it and do not use the service.

2. ⚠️ Medical disclaimer

Before starting any training program, we strongly recommend that you:

• Consult your doctor, especially if you are concerned by:
  • a cardiac, respiratory or metabolic condition (diabetes, hypertension, …)
  • recent or chronic injuries
  • being over 40 with no regular physical activity
  • a return to activity after pregnancy or surgery
• Obtain a medical certificate stating no contraindication to the practice of running
• Listen to your sensations during exercise and stop immediately in case of unusual pain, abnormal shortness of breath, malaise or dizziness

Physio Pacing disclaims all liability in the event of injury, malaise, worsening of a pre-existing condition or any other harm resulting from use of the App. You remain solely responsible for your sports practice and its compatibility with your health condition.

3. User account

3.1 Creation

Creating an account requires a valid email address. You may choose to sign in via Google Sign-In, Sign in with Apple, or with email + password. An email-verification message is sent upon sign-up.

3.2 Security

You are responsible for the confidentiality of your credentials. Report any unauthorized use immediately to contact@physiopacing.fr.

3.3 One account per person

Creating multiple accounts to circumvent the free trial limit (§4) is strictly prohibited. We reserve the right to block accounts detected as fraudulent.

3.4 Deletion

You can delete your account at any time from Profile → Delete my account, or by writing to contact@physiopacing.fr. See the privacy policy for details on data retention after deletion.

4. Premium subscription

4.1 Freemium model

Physio Pacing is a freemium service:

• Free trial: 30 days from account creation, with full access to all features (plan generation, sessions, load tracking, prevention, calculators, etc.).
• After the trial: the "My Plan" section becomes restricted. To keep generating and tracking a training plan, a Premium subscription is required.

4.2 Available plans

• Monthly: automatic renewal each month
• Yearly: automatic renewal each year (with savings compared to the monthly equivalent)

Prices shown in the App include all applicable taxes (VAT where applicable). They are displayed on the subscription screen before any purchase, in the currency of your Apple/Google account.

4.3 Payment

Payment is processed by:

• Google Play Billing on Android
• Apple App Store In-App Purchases on iOS

Physio Pacing never has access to your payment details.

4.4 Automatic renewal

Your subscription renews automatically at the end of each period unless cancelled at least 24 hours before the renewal date. The amount is charged to your payment method registered with Google Play or Apple.

4.5 Cancellation

You can cancel at any time:

• Android: Play Store → Account → Payments & subscriptions → Subscriptions → Physio Pacing → Cancel
• iOS: Settings → [your name] → Subscriptions → Physio Pacing → Cancel

Cancellation takes effect at the end of the current period. You keep your Premium access until that date.

4.6 Refunds

Refunds are handled directly by Google Play and Apple according to their respective policies. Physio Pacing is not able to process refunds directly.

4.7 Right of withdrawal

Pursuant to Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to digital services whose performance has begun with your express agreement and for which you have expressly waived your right of withdrawal. The 30-day free trial serves as an evaluation period.

5. Third-party services used

The App integrates third-party services which have their own terms and policies:

• Google Play Services and Apple App Store
• Firebase (Authentication, Firestore, Cloud Messaging, Crashlytics, Cloud Functions, App Check)
• Google Play Billing (Android) and Apple In-App Purchases (iOS)
• Google Sign-In and Sign in with Apple (authentication)
• Brevo (transactional email delivery)
• Health Connect (Android) and Apple HealthKit (iOS)
• Strava (activity import, OAuth 2.0)
• Coros, Garmin and Suunto (upcoming integrations for sending planned sessions to your watch)

6. Intellectual property

The App, its "Physio Pacing" brand, its logo, texts, illustrations, session catalogue, plan-generation algorithms, load-computation algorithms (Foster method) and risk-index algorithms (Acute-to-Chronic Workload Ratio) are the exclusive property of Gautier Maurickx.

Any reproduction, decompilation, reverse engineering or unauthorized use (beyond the personal use provided for in these Terms) is prohibited.

The data you provide (your sessions, your sport profile, your feelings) belongs to you — you can export it (GDPR portability) or delete it at any time. See the privacy policy §9 and §10.

7. Acceptable use

You undertake not to:

• Decompile, disassemble, reverse-engineer the App or attempt to extract its source code
• Automate use via bots, scripts, proxies or any other means not provided for by the interface
• Bypass security mechanisms (App Check, purchase validation, free-trial limit)
• Create multiple accounts to obtain multiple free trials
• Publish, resell, sub-license or redistribute the App or its data to third parties
• Use the App in a commercial context (e.g. paid athlete coaching) without written agreement from the publisher

8. Minors

The App is not intended for children under the age of 15 (French GDPR limit without parental consent) nor for those under 13 (COPPA limit in the United States).

Minors aged 15 to 17 must obtain prior consent from their parents or legal guardians to use the App. We reserve the right to request confirmation.

9. Limitation of liability

9.1 Service availability

Some features of the App require an Internet connection (Wi-Fi or your carrier's mobile network). Physio Pacing cannot be held liable for malfunctions due to the absence of a connection, insufficient carrier coverage, or roaming charges you may incur by using the App outside your usual territory.

9.2 Third-party data

Data synced from partner services (Health Connect, Apple HealthKit, Strava, upcoming Coros/Garmin/Suunto integrations) depends on their availability and accuracy — Physio Pacing cannot guarantee their continuous reliability or the absolute precision of their measurements.

9.3 Device and environment

You are responsible for the proper working order of your device (battery, memory, OS updates). If your device runs out of battery or updates while you are using the App, Physio Pacing cannot be held liable.

9.4 General scope

To the extent permitted by law, Physio Pacing shall not be liable for indirect damages (data loss, moral prejudice, loss of chance, missed gains) resulting from use or inability to use the App.

This clause does not apply to consumers where mandatory non-modifiable protections are afforded by the law applicable to their jurisdiction.

10. Updates and availability

We may release updates to the App at any time. Some may be mandatory to keep using the service (patching a security flaw, adapting to a third-party API change, for example). In that case, a blocking screen will invite you to update.

We may discontinue the service at any time. In case of planned shutdown, reasonable notice will be given to you, along with the ability to export your data before closure.

11. Changes to the Terms

We may amend these Terms. Substantial changes will be notified (in-app and/or by email). The date at the top of the document reflects the latest update. Continuing to use the App after notification constitutes acceptance of the new Terms.

12. Governing law and jurisdiction

These Terms are governed by French law.

Any dispute that cannot be resolved amicably falls under the jurisdiction of the French courts of the publisher's registered office, subject to the mandatory application of consumer-protection rules that may allow you to file with the court of your place of residence.
